TERMS AND CONDITIONS OF SALE

All goods must be prepaid. The prevailing rate of VAT (currently 17.5%) will be added to all goods supplied to EC countries (also applies to electronic delivery)
All goods despatched by post or courier will be subject to the appropiate charge as indicated in our current pricelist or order form.
If the following condition does not apply, Navtech Software will not refund any opened software, or once installed if supplied by electronic delivery...
Navtech Software will refund or replace any goods that are faulty or incomplete, provided they are returned in original condition within 14 days.
A returns number, obtainable from Navtech Software, must accompany any returns or the goods will not be accepted.
In the event of Navtech Software accepting a cancellation of the order which it will not be obliged to do so, but may do at its absolute discretion, a minimum cancellation charge of 25% of the price agreed, plus Value Added Tax will be payable or such larger amount as may be appropriate in time, materials and contribution to overheads
Where it is necessary, a unique machine ID may be requested which will constitute the registration number of your purchased software. In this instance, the software will only function on this particular machine. However, should the original machine be lost or damaged and a written declaration to this effect is received by Navtech Software, a replacement copy of the software will be provided. Usually this will be free of charge, however, Navtech Software reserves the right to charge an administration charge should the circumstances warrant this in our opinion.
The sole warranty regarding any of our Software products is that the original media of supply is free from physical defects in material and workmanship, assuming proper use, for a period of ninety (90) days from date of purchase ("Warranty Period"). If a defect occurs during this period, you may return your faulty media of supply to Navtech Software along with dated proof of purchase; Navtech Software will replace it free of charge. If such a defect occurs after the Warranty Period, you may send the defective disk to Navtech Software for a replacement disk, but Navtech Software reserves the right to charge you for a replacement disk. Navtech Software reserves the right to charge you for technical support services after the Warranty Period expires.
To the maximum extent permitted by applicable law, under no circumstances, and under no legal theory, tort, contract or otherwise, will Navtech Software or its licensors, be liable to you for any damages, including any lost profits, lost data or other indirect, special, incidental or consequential damages, arising out of the use or inability to use the Software or any data supplied, even if Navtech Software, its licensors or authorised Navtech Software dealer has been advised of the possibility of such damages, or for any claim of whatever nature by any other party. Your sole and exclusive remedy for any breach of warranty is that Navtech Software will at its option either refund you the purchase price or replace your Software as set forth above. Except for the express warranty of the original disks set forth herein and in the manual, any Software products are provided to you "As-Is". To the maximum extent permitted by applicable law, Navtech Software and its licensors, disclaim all other warranties, conditions or representations, expressed or implied, by statute or otherwise, regarding the Software, including the fitness for a particular purpose, quality, merchantability, or its noninfringement. In any event, the liability of Navtech Software or its licensors under the warranty set forth above is limited to the amount paid by the customer for the Software.
